FCT, Abuja – A Federal High Court in Abuja has thrown out a case seeking to quash the candidacy of Asiwaju Bola Ahmed Tinubu, the presidential standard-bearer for the ruling All Progressives Congress (APC) for the 2023 general election.

Bayo Onanuga, director of media and publicity for the APC Presidential Campaign Council (PCC), made it known in a statement on Wednesday, November 23 in Abuja, The nation informed.

The statement indicates that the Popular Action Party (APP) and others filed the case against the Independent National Electoral Commission (INEC) as the first defendant, Tinubu as the second and APC as the third.

The APP and others had asked the court to ask INEC to invalidate Tinubu’s nomination as the APC’s presidential candidate.

They alleged that Tinubu provided false information in its EC9 form submitted to INEC.

However, APC’s lawyer, Babatunde Ogala, filed a preliminary objection notice on the grounds that the lawsuit was time-barred, disclosed no cause of action, and that the plaintiff had no standing.

Onanuga said Ogala argued it was frivolous and a waste of the judiciary’s time.

“Judge Nwite subsequently threw out the case for lack of diligent prosecution,” Onanuga said.

Earlier, reported that Tinubu’s family called on Nigerians to dismiss the rumor about the background, health and age of the APC chairman hopeful.

According to the family, the APC presidential candidate is an original son of the Tinubu family in Lagos state.
